الذهب والفضة في ميزان الأحكام التكليفيّة

هذا البحث يهدف إلى بيان ما يتعلّق بالنقدين، الذهبِ والفضة، من الأحكامِ التكليفيّةِ من جوانبَ مختلفةٍ نجدُها منثورةً في الأبواب الفقهيّة عادة. فلمّا كان الذهبُ والفضة من نِعَم الله تعالى التي تَفَضّل بها علينا، وجعلهما الأصلَ في الأثمان وقِيمِ الأشياء، واهتمّ الناسُ بشأنهما على مرّ الأزمانِ وتعاقبِ العصور، كان من المهمّ جمعُ ما تفرّق ممّا يتعلّقُ باقتنائهما واستعمالهما من الأحكام التي يحتاجُ إليها المكلّف. وقد تناول هذا البحثُ التعريفَ بالأحكامِ التكليفيّةِ وأهميةَ النقدين في الحياة البشريّة. ثم جمعَ الأحكامَ المتعلّقةَ بأواني النقد وما أُلحقَ بها من المصنوعات، ثم ما يتعلّق بحُليّ الذهب والفضّة من الأحكام، من حيثيّة لبسِها للرجال والنساء وغيرِ ذلك، مع عرضِ آراءِ الفقهاء الأربعة في وجوب الزكاة في الحليّ على الخصوصِ. ثم تناول موضوعَ وجوب الزكاة في النقدين عمومًا وأثرَها في التكافل الاجتماعيّ، وألقى الضوء على مسألة وجوبها في الدَّين، واشتمل على ذكر نصاب الذهب والفضةِ باعتبار الأوزان المستحدَثة ومقابلتِها بالمقادير الشرعيّة. واللهَ أسأل أن يكون في هذا العمل النفعُ لي ولمن اطّلَع عليه، واللهُ الموفّق للصواب.
The goal of this research is clarifying what is related to bullion; gold and silver, from different perspectives of religious accountability that we normally find distributed throughout the books of fiqh. Since gold and silver are amongst the endowments of God Almighty upon us, and He made them the foundation for money and pricing items, and people have adhered to these two throughout the ages, it was important to collect their many distributed cases that the accountable person needs in one spot, such as the rules about merely keeping such items, or the rules of using them.
This research defines the rules of accountability and the importance of bullion in human life. It then gathers the rules pertaining to using or merely keeping utensils of gold or silver, or having them for decoration, and other matters. Then the rules pertaining to golden and silver jewelry worn by men and women were addressed, and other scenarios relating to bullion that could be needed. There shall be references to the opinions of the Four Scholars about the obligation of zakah on jewelry in particular. Then the discussion will include the general obligation of zakah for bullion, and the societal benefits from this. Light was also shed on the case of its religious obligation. It also includes mention of the zakah quota of gold and silver by current weight measures compared to standard religious measures.
